The High Court has issued a conservatory order suspending the prosecution of the Controller of Budget Margaret Nyakang'o following a petition filed by West Mugirango MP Stephen Mogaka.
Justice Chacha Mwita while issuing the order on Thursday, December 7 said he was satisfied that the petition raises pertinent questions
Mwita noted that the conservatory order in favor of Nyakang’o should remain in place until May 21, 2023, when the case will be mentioned.
“That a conservatory order is hereby issued suspending the prosecution of Margaret Nyakang'o In Mombasa Chief Magistrate's Criminal Case No. E1674 Of 2023, Republic V Margaret Nyakang'o and 10 others until 21st May 2024,” the order read in part.
Nyakang’o was arrested by the DCI detectives on Monday over conspiracy to defraud and operating a Sacco without a licence among other charges.

The CoB was presented before a Mombasa Court where she pleaded not guilty to the charges and was released on a cash bail of Ksh500,000.
In an interview on Wednesday, Nyakang’o revealed that she was trailed by a car while going home after a golf session in Karen.
Upon reaching home, the men who had trailed them disembarked on the car and approached the couple.
According to Nyakang'o, they introduced themselves and told her that she was required to record a statement at the Central Bank of Kenya (CBK) in Nairobi's Central Business District (CBD).
She tried to convince them to record the statement at her home, but they insisted on driving her back to Nairobi CBD.
After giving in to their demands the DCI detectives changed the narrative and drove her to Mombasa where she was presented to local DCI officers and later taken to court for prosecution.
