2 Former Senior NYS Officials Sentenced to Prison Without Option of Fine

Two former senior officials of the National Youth Service (NYS) have been sentenced to prison without the option of paying a fine.

In a statement on Wednesday, November 6, the Office of the Director of Public Prosecutions (ODPP) disclosed that Hendrick Nyongesa, a former head of procurement at NYS, was sentenced to seven years in prison after he was found guilty of making a false document.

Nyongesa was further handed a five-year jail term for breach of trust by a person employed in the public service, contrary to Section 127 (1) of the Penal Code.

"The court ordered that the sentences run concurrently, without the option of a fine. Nyongesa was convicted for these actions that took place on the 1st of December, 2014, at an unknown location within the Republic of Kenya," the ODPP stated.

On the other hand, former NYS Director of Finance Samuel Wachenje was sentenced to five years in prison without option of fine by a Nairobi court.

According to the court ruling, the duo committed a breach of trust by processing payments that led to loss of money at the service.

"Court ruled that Wachenje and Nyongesa, between the 1st of December, 2014, and the 5th of June, 2015, at the NYS headquarters in Nairobi, both being persons employed in the Public Service, committed a breach of trust by processing payments that led to the loss of money at the NYS," the ODPP remarked.

The court further heard that Nyongesa, together with others not before the court, made a false document purporting to be from the Ministry of Public Works with the intent to defraud.

Wachenje and Nyongesa were charged with conspiracy to defraud the National Youth Service of Ksh791 million.
