Justice Kullow was suspended by President Ruto in March 2024 following a recommendation from the Judicial Service Commission (JSC).

The Tribunal probing Environment and Land Court Judge Mohammed Noor Kullow has dismissed all allegations of gross misconduct against him. 

In a letter to President William Ruto on Monday, February 3, the tribunal noted that the thirteen allegations leveled against the Judge were not substantiated. 

“Pursuant to Article 168(7) of the Constitution and Gazette Notice No. 2536, the Tribunal has completed its inquiry. From the consideration of all evidence tendered and the applicable law, the Tribunal finds that the thirteen allegations have not been established to the required extent,” read the letter in part. 

The Tribunal recommended that Justice Kullow be reinstated as the Environment and Land Court judge. 

“Your Excellency, having found as above concerning the allegations against the Hon. Judge, the Tribunal unanimously recommends, therefore that the Hon. Mr. Justice Mohammed Noor Kullow, Judge of the Environment and Land Court, ought to be reinstated to the office of Judge of the Environment and Land Court,” the letter added.

President Ruto in March 8 2024 suspended Justice Kullow following the recommendation from the Judicial Service Commission (JSC).

The Head of State then formed a Tribunal chaired by Justice Patrick Omwenga Kiage to investigate the judge. 

Members of the Tribunal included; Lady Justice Margaret Njoki Mwangi, Lady Justice Cecilia Wathaiya Githua, Jinaro Kipkemoi Kibet, SC, Wanjiru Mwariri, Rukia Abdinasir Mohamed, Charles Mulila. 

Others were Emmanuel Bitta, (Lead Counsel) Jasper M. Mbiuki, and Collins K. Kiprono, (Joint Secretaries), and Caroline Jerono Kibwott and Georgiadis Majimbo (Assisting Counsel).

JSC had submitted four petitions to the President seeking Justice Kullow’s removal on grounds of incompetence, gross misconduct, violation of the Constitution, and breach of the Judicial Service (Code of Conduct and Ethics) Regulations, 2020. 

The Commission was concerned especially about how he handled 116 cases in Narok.
