All three suspects pleaded not guilty.

Three men have been arraigned before the Nairobi Anti-Corruption Court for allegedly impersonating officers from the Ethics and Anti-Corruption Commission (EACC) and the Office of the Director of Public Prosecutions (ODPP), in a scheme that defrauded a senior government official of Ksh125,600.

In a statement on Monday, May 26, the ODPP said the suspects, namely James Mbuvi Wangunze Kula, Mike Muthami Kasingi, and Raphael Muthoka Kithembe are facing seven charges.

The charges include four counts of impersonating an investigator, two counts of personating public servants, and one count of obtaining money by false pretence.

According to the ODPP, the offences occurred between February 17 and March 10, 2025.

During this period, the accused allegedly posed as officials from EACC in a bid to manipulate ongoing corruption investigations involving public officers.

“The Director of Public Prosecutions (DPP) has charged three men with multiple offences before the Nairobi Anti-Corruption Court, including impersonating investigators, personating public officers, and obtaining money by false pretence,” the statement read.

The court heard that Kula had claimed to be the Director of Investigations at EACC.

He allegedly approached a member of the public and falsely claimed that he had the authority to have a corruption case against them dropped.

“Kula, in particular, allegedly posed as the Director of Investigations at EACC and misled a member of the public into believing that a corruption case against them would be dropped,” the ODPP stated.

The prosecution further revealed that the accused had impersonated EACC officers while interacting with two Nairobi City County employees, as well as the Chief Engineer, Structural, at the State Department of Works. 

They allegedly claimed that they had the power to halt ongoing corruption investigations in exchange for payments.

“On 17th and 20th February 2025, Kula allegedly used a mobile phone registered on Truecaller as an ODPP officer to convince the two county officials that he was an EACC investigator and that the investigations would be closed,” the ODPP added.

In a separate incident, the trio is accused of impersonating an ODPP officer in an attempt to deceive the Chief Engineer into believing that a corruption case pending against him would be dismissed. 

This alleged impersonation culminated in the accused obtaining Ksh125,600 from the official on March 1, 2025.

“The trio is further alleged to have impersonated an officer from the Office of the Director of Public Prosecutions (ODPP) in an attempt to deceive the Chief Engineer, Structural, into believing that the corruption case against him would be dropped,” the ODPP said.

All three suspects pleaded not guilty to the charges.

Kula was granted release on a cash bail of Ksh300,000, while the court set the next mention of the case for June 10, 2025.
