Justice Chacha Mwita has barred the police from arresting Ndiangui Kinyagia following his appearance in court on Thursday, July 3.
In his directions to the police, the judge stated that the blogger could be taken to the DCI to record a statement if need be.
However, he has to be accompanied by his lawyer. Police cannot detain him after being questioned.
"In the meantime, the police will not arrest Ndiangui Kinyagia since he is now a petitioner in this matter and may be required to testify," Mwira guided.
"He should be presented by his advocate and not arrested or detained until further orders of this court."

Meanwhile, the judge also stated that the blogger be allowed time to consult with his lawyers and have his family take him for a medical checkup.
"The family has made a specific request to have time and speak to him, and get to know what has transpired, and also get to consult with the advocates.
"The family is granted time to have the petitioner with them and take him to the hospital for medical attention. This matter will be heard on the 18th and 24th of July," the judge directed.
Kinyagia has been missing for days. He was being pursued by the authorities, who believed that he drafted a timetable for the June 25 protests.
Initially, it was believed that he was in the custody of the police. DCI boss Amin Mohamed had denied the reports.
On Thursday, he emerged with his lawyers detailing that he was in hiding.
