The Ethics and Anti-Corruption Commission (EACC) has recovered Ksh 5,808,056 in salaries that were illegally paid to a former Medical Officer at Homa Bay County Government.
According to a statement released by EACC on Friday, July 18, the commission successfully secured the recovery of funds unlawfully disbursed to the doctor over a three-year period during which he maintained dual employment in violation of constitutional provisions.
In a judgment delivered on Friday, July 11, 2025, Justice Musyoki of the Milimani Anti-Corruption Court ordered full restitution of the salaries received by the doctor during his unlawful engagement in concurrent full-time positions at both the County Government of Homa Bay and Avenue Healthcare.
The court ruling follows comprehensive investigations by EACC, which revealed that the doctor drew a salary from the County Government of Homa Bay between August 2017 and August 2020, while concurrently holding the position of Branch Manager at Avenue Healthcare in Kisumu.
“This dual engagement violated Article 77(1) of the Constitution and Section 26 of the Leadership and Integrity Act, which prohibit full-time public officers from engaging in other gainful employment,” EACC explained.

In its decision, the Court affirmed that the doctor had illegally benefited from public funds and directed him to repay the full amount received, with interest accruing from the date of filing the suit.
“This judgment underscores EACC’s continued resolve to safeguard public resources and promote ethical conduct and accountability among public officers, particularly within county governments,” EACC added.
The Court awarded full costs of the case to the Commission.
