Former Kiambu Governor Ferdinand Waititu has suffered a major setback in his bid to have his 12-year prison sentence reviewed after the High Court rejected his application.

In a statement on Wednesday, September 17, the Office of the Director of Public Prosecutions (ODPP) said Lady Justice Lucy Njuguna on Tuesday, September 16, dismissed Waititu's bid to overturn his sentence.

"The Director of Public Prosecutions (DPP) has successfully opposed a bid by former Kiambu Governor Ferdinand Waititu, who is serving a 12-year prison term, to review his sentence. 

"Lady Justice Lucy Njuguna, in a ruling delivered on 16th September 2025, rejected an application filed on 28th August 2025, in which the former county boss sought to overturn his sentence on corruption-related charges," the statement read.

Justice Njuguna further directed that the sentencing remain in force until the hearing and determination of Waititu’s appeal. 

She ordered that the appeal be fast-tracked and concluded within 120 days, cautioning that any delays by the defense could result in the case being struck out.

"Meanwhile, Waititu will continue serving his term at Kamiti Maximum Prison, after failing to meet strict bond terms that required him to deposit a Ksh53 million bank guarantee," the statement added.

The matter is set to be mentioned again in court on October 1, 2025.

Waititu was on February 13, 2025, sentenced to serve 12 years in jail should he fail to pay a Ksh53.5 million fine.

In the sentencing delivered by Milimani Anti-Corruption Court Chief Magistrate Thomas Nzioki, Waititu's wife, Susan Wangari, was also fined Ksh500,000. 

The duo was found guilty of fraud and conflict of interest in a Ksh588 million graft case.

Waititu and his wife had been accused of benefiting from a county road tender through their company in a case that dates back to 2018, when Waititu was the county chief. 

According to the ODPP, the duo engaged in fraudulent procurement practices.

"Today, the Director of Public Prosecutions Renson Ingonga successfully proved to the court that the ex-county boss and his co-accused were guilty of conflict of interest, abuse of office, engaging in fraudulent practices in procurement, fraudulent acquisition of public property, and dealing with suspected property.

"Waititu was convicted by Chief Magistrate Thomas Nzyoki alongside his wife Susan Wangari Ndungu, Luka Mwangi Wahinya (former Chief Officer, Roads, Transport, Public Works and Utilities) Charles Chege Mbuthia and Beth Wangeci Mburu who are the Directors of Testimony Enterprises Limited, Testimony Enterprises Limited, Saika Two Estate Developers Limited, and Bienvenue Delta Hotel," the statement read in part.
