The Judicial Service Commission (JSC) has been allowed to nominate the next Chief Justice after the Court of Appeal made the ruling on Tuesday morning.
On Tuesday, April 27, 2021, the Court of Appeal stayed the orders issued by the High Court barring the recruitment of the Chief Justice.
Last week the High Court barred Judicial Service Commission from conducting interviews for the Supreme Court judge and making deliberations on CJ position pending case determination.
But the JSC rushed to the Court of Appeal to overturn the ruling. Three petitions were filed challenging Prof Olive Mugenda to chair the JSC panel.
“Take notice that the respondent herein being dissatisfied with the ruling delivered on March 21, 2021, intends to appeal to the Court of Appeal against the whole of the said ruling,” the notice by JSC read.
