Renowned lawyer Nelson Havi and his team has filed a petition at the High Court challenging the implementation of the Competency Based Curriculum (CBC) by the government and relevant agencies.

In a petition by Advocate Esther Ang’awa, the team has tagged CS in charge of Basic Education, KICD, KNEC, TSC, KNUT, Parliament, Interior CS Fred Matiang’i, and Education CS Prof George Magoha as the respondents.

In the petition, the Havi-led team argues that the curriculum review and introduction of CBC as a replacement for the 8-4-4 system was not done in accordance to the law.

The petitioner has requested the court to form a bench of at least 5 judges to hear and determine the outcome of the case.

Some of the prayers sought by the petitioner include; a halt of the implementation of the CBC and orders directing the relevant agencies to come up with new curricula guidelines and forward them to Parliament for approval.

“1st 2nd respondents to draw regulations in respect to policy and guideline on curricula in accordance with set laws and submit the same to Parliament within 90 days,” the petition read in part.

While notifying the public about the petition, Havi tweeted: “The petition challenging Competency Based Curriculum (CBC) has been filed. A request for a bench of not less than 5 Judges to hear it has been made. Read the petition and discover how the Ministry of Education has contravened every law and mismanaged education of children,” he said.

Over the past few weeks, there has been a massive debate online over the CBC curriculum. A section of Kenyans believe it is too expensive and demanding for parents, while others hold the view that it is the best way to go for our education system.

Despite the criticism, CS Magoha has maintained that CBC is the 'best thing' happening now.

"All this nonsense you are hearing ignore them and I can assure you. In my life, I think the only best thing that is happening now is the Competency-Based Curriculum. Let us not allow busybodies and politicians to divert us," the Education CS told the press a week ago.
