The Independent Electoral Boundaries Commission (IEBC) has stated that the list of nominated Members of the National Assembly and Senators will remain closed and unchanged.
In a statement by IEBC chairman Wafula Chebukati on Thursday, September 14, the party lists remained closed as at the date of the general election.
Chebukati said that the electoral commission used the party lists submitted by various political parties to allocate the special seats in the National Assembly and Senate in proportional representation.
The electoral agency on September 7 then gazetted the list of the names nominated to the National Assembly and the Senate from various political parties.

“In allocating the nomination slots, the commission applied the formulae developed under Regulation 56(2) of the Elections Regulations. The formulae which was applied through an electronic system is simple, secure and accurate and is without room for either human intervention or bias.
“We wish to inform the public that as per the Constitution and the Elections Act, the party lists remain a closed list as at the date of General Election,” Chebukati stated.
The IEBC chair, however, said that the list can only be changed through a court order.
The statement by Chebukati comes even as the High Court ordered IEBC to gazette Abubakar Talib as the duly nominated Member of Parliament for Wiper Party.
In the gazette notice by IEBC on Wednesday, September 7, IEBC failed to gazette the name of a Wiper nominee to Parliament in what it cited as a court order barring the commission from allocating the seat.
