Senator Linturi Locked in Fresh Row With Kitany

Meru Senator Mithika Linturi and his estranged wife Maryanne Kitany are locked in a new row.

This is after the Meru legislator appealed to the court on Monday, October 11, 2021, to have Kitany enjoined in a property case pitting him against his stepson Arnold Kipkirui.

In the property row, Kipkurui accused Linturi of fraud.

The court ruled that the senator's application had merit, in the sense that Kitany was the chief executive of officer of a company named Atticon Ltd, that the lawmaker allegedly used to acquire a Ksh7 million loan from Family Bank.

Kipkurui alleged that in 2015, the senator used the title deed of their land in Meru and among other assets as security for the loan.

“I have perused the record, I have not seen her name offered as a witness for any of the parties. It is alleged that she has evidence that can help the court completely adjudicate the case,” Justice Alfred Mabeya stated.

In the property case, key interests include; Kipkirui against Linturi, Atticon Ltd, Brenda Mithika, Emily Nkirote Buantai, Family Bank, the land registrar in Meru, Linkit Limited and the registrar of companies.

The case originated from the messy divorce between Kitany and Senator Linturi.

According to Kitany, she realised massive withdrawals from Atticon's bank accounts, which she claims were made by the Meru Senator.

She reported the matter to the Directorate of Criminal Investigations (DCI) who began investigations resulting in criminal charges against Linturi.

Justice Mabeya determined that there was proof Kitany was the CEO of Atticon since she had stated so in another case filed at a magistrate’s court. According to the file, appointed the company's CEO by its directors.

“Although Ms Kitany denied these allegations, a fact stated on oath cannot be denied. When denied, it reflects negatively on a party. It may be that she may have evidence that can assist the court unravel the dispute,” Justice Mabeya stated..

He further ruled that the court may miss an important opportunity of having a necessary person with crucial information to assist in the determination of the matter should Kitany fail to participate in the case.
