Nairobi Senator Johnson Sakaja has filed a sworn affidavit at the IEBC disputes resolution committee to clear himself from accusations of possessing a fake degree certificate.
Sakaja in the affidavit has raised key issues to discredit cases filed against him and even have them dismissed.
According to the court papers filed by Sakaja, he is a graduate of the Team University of Uganda where he graduated with a Bachelor of Science in Management.
Sakaja dismissed the argument that his name is missing in the graduation booklet of the University by saying the complaints filed had ignored pages where his name was.
"That the Complainants’ wild allegations to the effect that I did not graduate from Team University are and factually hollow and unfounded. For nefarious goals, the Complainants have fraudulently omitted relevant pages of the graduation booklet that bear my graduation credentials," part of the affidavit seen by Nairobileo.co.ke read.
He went on to say His University papers are certified by relevant authorities both in Kenya and Uganda adding that the IEBC should dismiss the case before it in totality.
Sakaja in a bid to trash the case also denied being the person in question saying he does not go by the name Johnson Koskei Sakaja.
"That I have never been known, identified or addressed by the name “SAKAJA KOSKEI JOHNSON” in any manner whatsoever, or associated with the 1st Respondent herein referred to as “SAKAJA KOSKEI JOHNSON” in Complaint No. 230 of 2022," the affidavit reads.
He said the person in question is not him even as he urged the IEBC court to dismiss the case since the person accused is not him.
Further, Sakaja said the case lacked merit because it was not filed within the constitutional timelines.
He said according to the law, the case challenging his clearance was filed past 24 hours, yet the law requires one to file a complaint not longer than that.
At the same time, he said the petition filed against him lacks merit as the UDA party which authorised him to vie for the seat was not enjoined in the case as required.
In that backdrop, Sakaja said the case lacked merit and asked the IEBC court to dismiss it.
