Justice Wamae Cherere in a ruling said the  Meru County Assembly did not follow legal procedures in initiating the motion.


A high Court in Meru has stopped an impeachment proceeding against governor Kawira Mwangaza that had started at the Meru County Assembly.

The impeachment motion was tabled by Abogeta West MCA Dennis Kiogora on November 21. Kiogora is also the Minority Chief Whip.

Justice Wamae Cherere in a ruling said the  Meru County Assembly did not follow legal procedures in initiating the motion.

The ruling come after the Governor, a week ago, moved to the high court seeking a gag order barring the Assembly from debating her ouster.

Her Lawyer Elias Mutuma argued that the impeachment motion was called and signed by a stranger in the Assembly acting as clerk.

Through her lawyer, she argued that the Assembly seemed to have had a pre-determined mindset since 68 out of 69 MCAs had approved the impeachment motion.

The impeachment motion against the Governor was to be debated today (Wednesday, November 30) at the County Assembly.

The Governor has been embroiled in a push-and-pull with the MCAs with several accusations being levelled against her.

The Governor's woes began after she denied MCAs ward development fund saying it is not anchored in law.
