Senior Counsel Ahmednasir Abdullahi now wants ODM leader Raila Odinga probed for confessing that he hacked the IEBC servers.
The lawyer says the ODM leader was simply confessing that he failed to successfully steal elections, something he termed as an election offence.
Ahmednasir now wants the police IG Japhet Koome to open a criminal inquiry against Raila over the matter.
"Hon Raila confesses to "ethical" stealing of the August 2022 election. That he failed to successfully steal (Raila rarely succeeds in anything) doesn't mean he didn't commit a criminal offence. His confession is unequivocal. The IG of the police must open a criminal inquiry," he said.

On Monday ODM leader Raila said they sought the services of foreign hackers to know the truth about the August 9, polls.
He said the hacker came into the country to gather facts about the last elections during which they were traced by the state forcing them to leave the country.
He however said they managed to gather key information about how the August 9, 2022 polls were rigged.
It is on the basis of their finding that Raila has led his troops in rejecting the Presidency of William Ruto terming it as illegitimate.
