A number of properties belonging to Keroche Breweries are set for auction to recover Sh45 million awarded to former manager Sam Shollei for wrongful dismission from work.
The court ordered Keoche to pay Shollei the amount after ruling that his sack from the company did not follow legal procedures.
Employment and Labour Relations Court judge Hellen Wasilwa ruled that the company did not inform Shollei of the reason for the dismissal nor subject him to any disciplinary process when it fired him in 2018.
“As provided under Section 45(2) of the Employment Act 2007, the termination of the contract was unfair and unjustified,” the judge said.

The company, however, is yet to make payment for the money as ordered by the court.
"Under instructions received from the Employment & Labour Relations court at Nakuru, we shall sell the under-mentioned goods, vehicles, plant, machinery, and accessories by public auction on Tuesday, October 31, 2023, at 11.00 am at our Head Office", the auction notice by Okuku Agencies seen by Nairobi Leo stated.
The items set to be auctioned are Chairs, Desks, Drawers, Computers, Printers, Cabinets, Plant machinery & accessories, motor vehicles, and trucks.
"Highest Bidder shall be declared the purchaser subject to compliance with the conditions of sale," the Okuku auctioneers agencies stated.
The conditions of the sale are Cash/Bankers Cheque and Electronic Funds Transfer at the fall of the hammer.
Bidders are required to make a refundable deposit of Sh1,000,000.00.
"Viewing is allowed during normal working hours upon prior arrangement with the auctioneers and the Sale is subject to a reserve price," the notice indicated.
