Police are seeking to detain activist Boniface Mwangi for a period of 21 days pending an investigation of alleged offences against him.

In court papers seen by Nairobileo.co.ke on Friday, July 26, Mwangi and four others are being investigated for offences of false publication, taking part in unlawful assembly and creating disturbance.

The four others are Robert Otieno, Albert Wambugu, Pablo Chacha and Erot Franco.

"In light of the foregoing, I pray this honourable court to issue custodial orders authorising holding of the respondents in the applicant's custody for 21 days to enable the applicant to conclude its investigations," read part of affidavit by the police.

In the application, the five were also accused of inconveniencing road users by blocking the road during the anti-government protests on Thursday, July 25.

At the same time, the police claimed that Mwangi and his co-accused posted allegations on social media that the government was out to kill citizens.

"On 25th July 2024 around 1130hrs or thereabout at Nairobi Central Business District, along Koinange Street the respondents with others caused a breach of peace and inconvenienced other road users by blocking the road by placing one white coffin and seven white crosses with names inscribed on them.

"The respondents during the blocking of the said road, were distributing T-shirts and placards labelled with incitement words. That, the respondents through various social media platforms had posted allegations that the government was out to kill its citizens which words were deemed and construed that the government was perpetrating extrajudicial killings; posts which incited members of the public, causing a breach of peace," the affidavit further read.

Police said investigations into the crimes were ongoing to establish the motive for carrying the various items with which they were arrested.

"Investigations are ongoing and there is a need to establish where the white coffin and the white crosses were sourced from as well as establish their financier(s)," the affidavit stated.
