Sifuna’s remarks come in the wake of the discovery of Justus Mutumwa and Martin Mwau's bodies at the City Mortuary under suspicious circumstances.

Nairobi Senator Edwin Sifuna has taken issue with the management of Nairobi City Mortuary and the Nairobi County Government, accusing them of being complicit in the abduction and killing of Kenyans. 

In a statement on Friday, January 31, Sifuna questioned how the bodies of Justus Mutumwa and Martin Mwau, which had reportedly been at the mortuary since December 18, were initially untraceable when families visited to search for their missing relatives.

He suggested that the mortuary's management is working in cahoots with the abductors, and action must be taken against it.

"Nairobi City Mortuary, its management and the County Government are complicit in the abduction and killing of Kenyans. How is it that the bodies of the men from Mlolongo have been there since December 18 and when families visited the facility they couldn’t find them? It is clear the management is in cahoots with the abductors and must be held to account," he said.

Sifuna’s remarks come in the wake of the discovery of the bodies of the two men at City Mortuary under suspicious circumstances.

Speaking on Thursday, January 30, lawyer Dan Maanzo said Mutumwa's body was discovered in Ruai before it was moved to the City Mortuary.

"There are two bodies. One has not yet been identified. The body of the first petitioner (Justus Mutumwa), which was originally found in Ruai, has been identified by his family. The family was called to the City Mortuary and identified the body. They have checked the fingerprints and confirmed it is him.

"He disappeared on December 12, 2024, when the others disappeared and the family began searching for him. According to the information the family was given at City Mortuary, the body was brought to the facility a few days ago," he said.

The body of Mwau who went missing alongside Mutumwa was also found at City Mortuary soon after the discovery of Mutumwa's body.

Earlier Wednesday, Directorate of Criminal Investigations (DCI) Director Mohamed Amin appeared before the High Court and clarified that the National Police Service (NPS) was not involved in the custody of the missing persons.

"I wish to state that the missing persons are not under the custody of the National Police Service. We have not arrested them and they are not under our custody. Under the circumstances we can neither produce their bodies nor can we formally prefer any charges against them," he said.
