In a statement on Thursday, May 1, Mutua defended his decision to take up the role, stating that he was qualified and eager to serve the country.
“Why are some folks vexed, anguished, about my decision to accept the appointment by President William Ruto as Senior Advisor on Constitutional Affairs? I’ve spent my entire life in the law at the highest levels, especially in the United States. I can’t think of a better way to serve my native Kenya," he said.
Mutua noted that most of the people criticising him would have taken the role if appointed, adding that he believes his expertise will benefit the country.
"I am sure some of those upset would readily accept the appointment. Chill, folks, and let those who are qualified serve the country. I believe my expertise will be of good service to the President and the country," he added.
