Former Kiambu Governor Ferdinand Waititu has suffered another blow after the court dismissed his bail application for the second time.

In a ruling on Thursday, May 8, Justice Lucy Njuguna rejected Waititu’s application, citing insufficient grounds to warrant his release.

“This court is not persuaded by the applicants and in respect to the present application and for the reasons this court has given, it holds a strong view that the application lacks merit and I struck it out,” Justice Njuguna ruled.

Waititu will remain held at Kamiti Maximum Security Prison until his appeal is heard and determined.

This is the second time Waitutu has been denied release on bail pending the determination of his appeal in a Ksh588 million corruption case.

On March 3, Justice Njuguna denied Waititu his request for bail over not presenting sufficient grounds to warrant his release.

However, he filed a fresh application before the same court through his lawyers led by Kibe Mungai seeking to be released on bail.

The Office of the Director of Public Prosecutions, however, opposed the bail application by the former governor. 

Waititu was sentenced on February 13 to serve 12 years in jail or an alternative fine of Ksh53.5 million.

The former Kiambu Governor and his wife, Susan Wangari, were found guilty of conflict of interest and dealing with suspect property offences after corruptly receiving millions from Kiambu county through a multi-million roads tender.

Wangari was sentenced to serve a jail term of one year if she defaults in paying the Ksh500,000 fine.
