ODM expressed concern over the government's failure to settle the substantial amount.

The Orange Democratic Movement (ODM) has resolved to pursue legal action against the National Treasury over an outstanding Ksh12.6 billion owed to the party. 

In a statement released Thursday, August 28, the party's Central Committee expressed concern over the government's failure to settle the substantial debt owed to ODM.

"The committee has resolved to explore executive proceedings against the National Treasury for recovery of this amount,” the statement read. 

The decision follows the committee’s meeting to deliberate on critical matters affecting the party and the nation, where members also received and adopted the Financial Report for the 2024/2025 financial year during the meeting.

"The Committee received and adopted the Financial Report for the 2024/2025 financial year and commended the National Treasurer and the National Secretariat for their excellent stewardship and prudent management of the Party's resources,” the statement added.

The meeting also addressed recent party elections at the branch and county levels, noting that while some branches have completed their electoral processes successfully, several areas require attention.

The committee specifically highlighted cases in Busia and Kakamega counties where repeat elections are scheduled for August 29 and September 1, respectively.

Looking ahead, the Central Committee confirmed that ODM will field candidates in the upcoming by-elections scheduled for November 27, 2025, covering all seven of the 23 Electoral Areas.

"The NECC has been directed to invite applications from candidates in those areas, save for Magarini Constituency and Fufu ward, where it is proposed to issue direct tickets to our 2022 candidates."

The announcement comes as the Independent Electoral and Boundaries Commission has set November 27, 2025, as the date for multiple by-elections across various counties.

The electoral commission had issued a gazette notice confirming that all by-elections would be conducted on this single date, with the process scheduled in two separate batches. 

These by-elections will fill vacant Member of County Assembly positions across several wards, including Angata Nanyokie in Samburu, Chemundu/Kapng'etuny in Nandi, Chewani in Tana River, Fafi in Garissa, Kariobangi North in Nairobi City, Kisa East in Kakamega, and multiple other constituencies across different counties.
