Justice Githua had found Obado and his co-accused guilty of Sharon Otieno's murder.

On Wednesday, September 16, Lady Justice Cecilia Githua of the High Court in Nairobi set a date to deliver her ruling on the sentencing of former Migori Governor Okoth Obado and his two co-accused in the Sharon Otieno murder case.

Justice Githua confirmed that the ruling will be delivered at 10.30 a.m. on Friday, November 27 at the Milimani Law Courts.

She settled on the date after listening to and receiving submissions from both parties during the mitigation hearings.

"The court has heard the submissions that have been presented by all the parties, including the views of the secondary victims.

"It will now retire to consider what has been highlighted today and the material that has been filed by the parties together with the written submissions on mitigation and will deliver its ruling on sentence on November 27," the Judge determined.

Justice Githua explained the prolonged waiting time, stating that the court was proceeding for its annual leave.

"You will recall that I had indicated earlier that the court is commencing its annual leave tomorrow. That is why it will deliver its sentence on the said date," she stated.

Earlier, the late Otieno's mother, Melida Ouma, pleaded with the court not to impose a custodial sentence on Obado. She told the court that the former County Chief could help her support the victim's three children.

"Don't crucify Obado in this case; Sharon left her three children behind, and I have struggled through this journey. If he is granted a non-custodial sentence, at least he'll be able to help us take care of these children," she said.

On his part, Douglas Otieno told the court that he had forgiven Obado, after the former Governor sent emissaries to his house in an attempt to foster reconciliation. 

However, he made it clear that he would not forgive the two co-accused because they remained non-remorseful. He argued that the two deserved a custodial sentence.

Obado, his former Personal Assistant Michael Oyamo and former Migori County Clerk Caspal Obiero were found guilty of Sharon's murder after the court determined that the prosecution had presented sufficient evidence linking the three to the killing.
