EACC said that Justice Ougo dismissed five applications by Governor Wamatangi and other defendants seeking to strike out its recovery suit.
The Ethics and Anti-Corruption Commission (EACC) has been given the go-ahead to recover Ksh813.1 million from Kiambu Governor Kimani Wamatangi and other defendants.
In a statement issued on Friday, October 2, EACC said that Justice Rose Ougo of the High Court dismissed five applications by Governor Wamatangi and other defendants seeking to strike out its recovery suit.
The money is linked to alleged irregularities in road tender awards to five companies where the County Boss is said to have held a beneficial interest.
"In her ruling dated 1st October 2026, Justice R. E. Ougo held that the allegations of fraud, misrepresentation and falsification of tender documents require evidence to be tested at a full hearing.
"Whether the company directors can be held personally liable must also be determined through that process," the statement read.

In the lawsuit, it is alleged that Wamatangi, while serving as a Senator, used his position to influence tender awards to companies in which he held a beneficial interest, and that forged or falsified documents were used to secure the contracts.
These were contracts awarded to the firms by Kenya Urban Roads Authority (KURA), Kenya Rural Roads Authority (KeRRA) and Kenya National Highways Authority (KeNHA).
"The Commission seeks recovery of Ksh813,145,532.40 from the defendants jointly and severally, alongside forfeiture of funds held in the companies’ bank accounts," EACC wrote.
EACC explained that the Court held that parliamentary privilege does not shield alleged unlawful conduct, and that Governor Wamatangi had not established that the recovery suit duplicated the issues in his pending constitutional petition.
Consequently, the recovery suit will proceed to full hearing. Justice Ougo directed that the costs of the applications be in the cause.
Earlier, EACC announced it had secured the recovery of a public road reserve in Mombasa valued at approximately Ksh25 million following a judgment by the Environment and Land Court.
In a statement on Tuesday, September 29, the Commission said the property, identified as Mombasa Municipality/Block XIX/305, is located along Machakos Road and provides an access route to the University of Nairobi, Mombasa Campus.
