Gatundu South Member of Parliament Moses Kuria has hit out at President Uhuru Kenyatta over his criticism of the Judiciary during the Madaraka Day celebrations in Kisumu on Tuesday.
While presiding over the event, the President took issue with the High Court for terming BBI Bill unconstitutional.
The Head of State argued that by declaring the BBI Bll unconstitutional, the court was subverting the will of the people, considering that over 3 million Kenyans had endorsed BBI.
“…The Judiciary has tested our constitutional limit…If the court had subjected its decision to stop BBI to a cost benefit analysis, in other words if it had considered the burden of choice, then, these are the questions the Judiciary would have asked: If we are in a constitutional moment, is a decision against BBI a decision in support of the status quo?

“If BBI were to be stopped, who carries the burden of choice? On whose shoulders will ethnic majoritarianism rest? And who will carry the burden of losing 30 per cent of our national budget every five years due to the toxic politics that BBI seeks to resolve?” he posed.
Reacting to the President’s remarks, Kuria compared him to late President Daniel Toroitich Arap Moi, noting that even though the latter had his faults, he was not that mean to the judiciary.
“Even Moi was never this unkind and intimidating to the Judiciary. And on no other day than Madaraka Day. Nooo. You are that one person who is gaining by inflicting pain on the Nation. Shocking! Frightening! Stay Woke Kenyans!” he posted on his socials.
