Suna East MP Junet Mohamed has exuded confidence in his legal team led by Senator James Orengo and Otiende Amollo that are seeking to overturn High Court ruling that declared the BBI process unconstitutional. 

Rarieda MP Otiende Amollo on Wednesday told the court of appeal that the Building Bridges Initiative (BBI) was a popular initiative promoted by MP Junet Mohammed and Dennis Waweru and not President Uhuru Kenyatta.

Responding to the claim by Amollo, Junet tweeted, "As the BBI Promoter, together with my brother Hon. Dennis Waweru, I’m very confident in the representation of my legal team." 


Speaking before 7 Court of Appeal judges, SC Amollo stated that the High Court was wrong in declaring that BBI was an initiative of President Uhuru Kenyatta.

"Against all uncontroverted evidence, the promoters of this initiative were Dennis Waweru & Junet Mohamed, the court insists on finding Pres. Kenyatta as the promoter. Anyone can support the initiative.

"The one thing the court does not do in their 300 page judgement is fail to ask who are the promoters. BBI is an initiative promoted by Waweru and Junet. They engaged with the IEBC and collected the signatures," Amollo told the court. 

The High Court, on 13th May 2021, declared the Building Bridges Initiative (BBI) driven Constitution of Kenya Amendment Bill 2020 as unconstitutional.

The five-judge bench of Justices Joel Ngugi, George Odunga, Jairus Ngaah, Teresia Matheka and Chacha Mwita said an amendment can either be initiated by a Parliamentary or popular initiative, not the President.
