In a memo on Monday, November 29, 2021, the Machakos County boss stated that his suspension will pave way for his removal from office.

The governor noted that the suspension and pending removal was necessitated by a number of factors including gross violation of the Constitution of Kenya and other laws.
Kathili faces accusations of gross misconduct, incompetence, dereliction of duties as well as unethical and unprofessional conduct.
"In accordance with Section 13 of the Office of County Attorney Act. 2020. I will be transmitting the specific reasons for this decision to the County Assembly for approval of his removal from office," the memo concluded.
This comes at a time when Governor Mutua continues his stance against incompetence within the county government.
The governor has been vocal in the push for public servants to value their work and serve the people in accordance with the Constitution.
Mutua has been critical of corruption and abuse of office both at the county and national levels.
Kathili was sworn in as the county attorney on November 30, 2021.
