The judge also gave directives over the next appearance of Kanja and DCI boss Amin

Justice Chacha Mwita has ruled that the Inspector General of Police Douglas Kanja was duly served to appear before the court to explain the whereabouts of 3 men who were abducted in Mlolongo.

In a ruling on Thursday, January 23, Mwita also ruled that the Directorate of Criminal Investigations (DCI) boss Mohamed Amin was also properly served.

Consequently, the court struck out their application to the court, denying having been served.

On the other hand, the two were directed to appear in court in person on Thursday, January 30.

The judge also directed that the duo also present the Mlolongo three namely; Justus Mutumwa, Martin Mwau and Karani Muema whether alive or dead on the said date.

Kanja and Amin failed to appear in court last week. Through their lawyer, the duo argued that they were not properly served.

"The affidavit of service sworn on January 13 is not proof of service by way of electronic mail as it does not state that email addresses through which the IG and DCI were purportedly served, were their last confirmed and used email addresses," lawyer Paul Nyamodi argued in court on behalf of their clients.

Meanwhile, speaking during a police event earlier in the week, Kanja maintained that he would honour court summons in the ongoing cases regarding abductions.

"There is no problem and when the time will come for me to appear in court, I will be there personally," Kanja stated.
