President William Ruto on Monday suffered a blow after the High Court declared the 50 CASs posts illegal.


Senior Counsel Ahmednasir Abdullahi has predicted doom in the event President William Ruto's government appeals against the High Court ruling quashing the appointment of 50 CASs into office.

In a tweet on Tuesday, the senior counsel warned that if the government moves to the higher court, the case will suffer a similar fate to that of the Building Bridges Initiative (BBI).

The BBI suffered a blow at the High Court, Court of Appeal and the Supreme Court of Kenya.

"The Attorney General should not appeal the 50 CAS case to the Court of Appeal. If he appeals...the route is that the courts took through the BBI process," he tweeted.

The court went on to quash the 50 appointments made by President William Ruto.

Justices Kanyi Kimondo and Ali Visram said it was not the intention of the framers of the constitution to have 50 CASs deputise 22 Cabinet Secretaries.

Justice Hedwig Ong'udi however disagreed with the decision terming the office unconstitutional.

Ruto on March 16, nominated 50 CASs for the position against 23 vacancies announced by the Public Service Commission.

They were nominated from a list of 240 shortlisted candidates.

The 50 CASs took the oath of office on March 23, 2023, after the National Assembly declined to vet them, saying it had no constitutional authority to do so.
