Governors have filed a petition at the high court in Nairobi seeking protection from being denied access to their offices once charged with graft.
The county bosses through the Council of Governors (CoG) are challenging the constitutionality of having them barred from accessing their offices when facing graft charges.
In the petition, they have listed the Ethics and Anti-Corruption Commission (EACC), the Director of Public Prosecutions (DPP) and the Inspector General of Police as respondents.
High Court judge James Makau on Monday certified the matter as urgent and ordered that direction on hearing the petition be given by a panel of three judges on October 21, 2020.
High Court Judge Mumbi Ngugi in a ruling which the governors are seeking to discredit held that governors facing graft charges can only access their offices only with written permission from the EACC.

There have been at five governors that have been affected by the ruling with the ruling's critics arguing that blocking the leaders hinders service delivery.
Governor Mike Sonko, Okoth Obado, Muthomi Njuki, Ali Korane and Ferdinand Waititu have all been faced by the court ruling after they were blocked from accessing their offices.
The governors have corruption cases pending in court. Governor Ferdinand Waititu was impeached out of being implicated in graft.
