Court did not Decline to Lift Red Alerts against Miguna – Havi Clarifies

Law Society of Kenya (LSK) President Nelson Havi has clarified on the ruling issued by the court regarding red alerts issued against Miguna Miguna, noting that the court did not decline to lift the alerts as reported by a section of the media.

According to Havi, the court noted that the government had assured it that there are no alerts against Miguna, therefore, there was nothing to be lifted.

“Justice Hedwig Ongudi emphasized that the Government of Kenya must allow Miguna Miguna to return home on 16-11-2021 having indicated that no red alerts exist. This is in accordance with the obligation imposed upon it by the Constitution and existing orders on the matter.

“The media has misinterpreted and misreported the ruling and order by Justice Hedwig Ongudi on the red alerts removal request by Miguna Miguna. The Court did not decline to lift the alerts. The Court noted that the Government of Kenya had confirmed that there are no alerts,” Havi said.

Meanwhile, Miguna Miguna has vowed to return to the country has planned noting that he has already booked a ticket and will be arriving in the country on November 15, 2021.

“I will proceed with my journey as previously communicated and in accordance with Justice Chacha Mwita's Order of December 14, 2018 and Justice Weldon Korir's Order of January 6, 2020. If I am blocked again, the matter will return to court. If not, see you soon. Viva!

“These are my flight details on @airfrance AF 836, Airbus A320, from Berlin-Paris-Nairobi on Monday November 15, 2021. I'll update everyone on November 15, 2021, if @airfrance stops me from boarding because of the red alerts by State House,” Miguna’s statement read in part.
