LSK Calls for Suspension of MPs’ Salaries Following Maraga’s Parliament Dissolution Advise

The Law Society of Kenya (LSK) through its president Nelson Havi has called for the suspension of salaries for Members of Parliament effective October 12, 2020 following Chief Justice David Maraga’s dissolution advice to President Uhuru Kenyatta.

In a statement earlier today, Havi noted that LSK has written to the relevant authorities including the National Treasury seeking to stop remittance of MPs salaries on the above mentioned date.

The society also wants Inspector General Hillary Mutyambai to withdraw security detail attached to the MPs when the time provided by the Constitution expires.

According to LSK, from October 12, Parliament as currently constituted shall be unconstitutional.

“The President will be in violation of the Constitution should he fail to dissolve Parliament on or before October 12, 2020. Regardless of the President's action or inaction, Parliament will be unlawful effective October 12, 2020.

“…“Mindful of the impunity that have been perpetuated by Parliament and the Speakers of the National Assembly and the Senate, we have written to the Cabinet Secretary in charge of the National Treasury, to cease the remittance of salaries and allowances to members of the National Assembly and Senators of the Twelfth Parliament with effect from October 12. Man shall not eat what he has not laboured for…,” LSK’s statement read in part.

PSC Set to challenge Maraga’s advise in court

Meanwhile, Parliament through the Parliamentary Service Commission (PSC) earlier this week announced that it will be challenging Maraga’s advise to the President at the High Court.

According to PSC, Parliament cannot be dissolved over the implementation of the gender rule.
