Naivasha MP Jayne Kihara will now defend her parliamentary set on a UDA party ticket.
This is after the Elections and Nominations Dispute Resolution Committee ruled that she won the primaries held on Thursday last week in which her fierce competitor John Karanja Kihagi was announced the winner.
In the results announced last week, Kihagi was announced as the winner after garnering 9852 votes against Kihara who was said to have garnered 9824 votes.
The incumbent however appealed to the dispute committee where she argued that the results of two polling stations were not included in the final tally.
In her submission, the results of the two polling stations were enough to overturn her competitor's win, an argument the committee concurred with.
"The Committee finds that the failure to include the results of Maua Primary School polling station and Milimani Secondary School polling station in the final tally had a significant bearing on the final outcome that overturns the results as announced by the Returning Officer for Naivasha constituency and rejects the assertion by Counsel for the 1st Respondent that their non-inclusion was insignificant and had no bearing on the final result," the Committee said.
In Milimani secondary school polling station, Kihara defeated Kihangi after getting 23 votes against 16.
In the Maua primary, she also won after getting 57 votes against Kihangi's 35 votes.
The two polling stations gave her 29 votes required to overturn Kihangi's win since she had been defeated by 28 votes.
"The Committee finds that when the results from the aforementioned polling stations are added to the final tally, which the Committee confirmed to be 9852 votes for the 1st Respondent and 9824 votes for the Applicant, the final result is that the 1st Respondent garnered 9,903 votes to the Applicant’s 9904 votes."
The Committee in consequence resolved to hand her the victory.
"In the upshot, the order that commends itself is an order directing the 2nd Respondent to forthwith issue a nomination certificate to Jane Wanjiru Kihara, the duly nominated Member of National Assembly (MNA) for Naivasha Constituency in Nakuru County."
