Wajir Member of County Assembly (MCA) Yussuf Hussein Ahmed has been found dead more than a month after he was reported missing.

The mutilated body of the Della Anole Ward MCA was found in Lake Yamud within Wajir County.

Yussuf's family positively identified the body with witnesses saying it bore signs of severe torture including extensive burns.

Yussuf went missing on September 13, 2024, after being allegedly abducted in Nairobi's South B Estate. 

His family claimed he was taken from a taxi by armed individuals, prompting them to file a High Court petition against the Inspector General of Police and the Directorate of Criminal Investigations, demanding his immediate production in court.

"It is illegal and unconstitutional for the IG and the DCI to treat Yusuf as a second-class citizen and subject him to inhumane and degrading treatment.

"In any event, Yusuf has an absolute right to habeas corpus and to a fair trial, therefore, he should be subjected to due process of the law other than abducting him and leaving his loved ones worrying about his whereabouts," the petition read.

The family's distress escalated as they sought legal intervention, fearing for his safety and alleging that law enforcement may be involved in his disappearance. 

They argued that his constitutional rights were being violated due to the lack of information regarding his whereabouts.

"The whereabouts of Yusuf remain unknown and unaccounted for and there is a reasonable fear that he was abducted by the officers attached to (the IG and DCI) who have refused to either allow his family to visit him in custody and or have refused to present him before a court of law to answer to any charge in law," the petition further read.

Despite efforts to locate him, including visits to multiple police stations, Yussuf remained missing until the discovery of his body recently.

While appearing before the National Assembly Committee on National Security on September 26, 2024, Interior CS Kithure Kindiki said he was unaware of Yussuf's whereabouts.

Kindiki stated that he would not participate in a plan that could endanger an innocent citizen, further committing to providing an updated report on the status of the investigations related to the case.

"I want to plead with a committee to give me time to prepare a statement. I'm aware of the matter but I need an updated verifiable statement. I'm aware of what happened and I'm aware that some progress is being made to make sure that there is accountability," he told the committee.
