  • Sonko's application to stop his prosecution in a Sh357 million graft case was declined by the High Court

Ex-Nairobi Governor Mike Sonko has suffered a setback in his bid to block his prosecution in a case where is accused of misappropriating Sh357 Million while serving as Nairobi Governor.

Sonko had filed an application requesting the court to block his prosecution until a ruling is issued on his petition where he claims his right for a fair trial was not provided.

However, in a ruling on Tuesday, Justice James Wakiaga dismissed Sonko’s application noting that the ex-Nairobi Governor did not provide evidence demonstrating his claims.

According to Justice Wakiaga, Sonko will not suffer any prejudice if the case proceeds as they wait for the ruling on his application.


Justice Wakiaga further noted that suspending the case will amount to interference with the administration of justice.

“An order for stay of proceedings, particularly stay of criminal proceedings is made sparingly and only in exceptional circumstances,” Justice Wakiaga ruled.

The case is set to be mentioned on March 23, 2021, before the Deputy Registrar of the High Court.

Meanwhile, Sonko is also facing terror-related charges and is expected to be presented to the Kahawa Law Courts soon for hearing of the case.

The ex-Nairobi Governor is currently admitted at Nairobi Hospital after he became ill while in police custody.
