The Anti-corruption court has directed the Director of Public Prosecution to file a formal charge on former FKF President Nick Mwendwa within seven days or close the file.
Milimani Senior Principal Magistrate Wandia Nyamu, in the ruling, declined to detain Mwendwa for 14 days.
She added that the Police exhibited bad faith by detaining him over the weekend without a holding charge.
"Police arrested and detained Mwendwa irregularly which exhibited bad faith. They brought him to the court without a holding charge even after detaining him for a whole weekend," Magistrate Nyamu ruled.

She also noted that the ruling delivered on Monday, November 15, on Mwendwa's bond would remain as so.
The embattled president was released on a Ksh 7Million bond with two sureties or a cash bail of Kshs 4M with two contact people.
Police arrested Mwendwa last week on Friday, the day after the sports ministry announced that a caretaker committee would run the federation for six months while authorities investigate allegations of financial irregularities during his tenure.
Hours after the arrest and the disbandment of FKF by CS Amina Mohamed, FIFA threatened to ban Kenya from participating in its activities if the government fails to rescind its decision.
“We kindly ask you to inform the Cabinet Secretary that in the event her decision to appoint an FKF Caretaker Committee and the correlated secretariat was to be upheld, we would have no other choice than to submit the present matter to the Bureau of Fifa Council for consideration and decision,” part of the statement by FIFA.
