The former legislator had been convicted on a 12-month jail term by the court after being found guilty of assault.

The incident occurred in 2016 when the Orange Democratic Movement member slapped then Nominated MP Sarah Korere at the late Interior Cabinet Secretary Joseph Nkaissery's office at Harambee House.

Principal Magistrate Helen Okwani in a ruling found that he indeed assault the female colleague and did not produce evidence supporting his allegations that it was him who had been assaulted.

"(Lempurkel) willfully and unlawfully assaulted Sarah Korere by slapping her on the left cheek and kicked her on the lower abdomen thereby occasioning her actual bodily harm," court papers read in part.

However, Lempurkel’s lawyer Saitabao Kanchori moved to court challenging the ruling stating it was a mistake.

“The trial magistrate erred in law and in fact by totally disregarding the unchallenged evidence of an eyewitness who testified under oath how Ms. Lekorere accosted and attacked Mr. Lempurkel in the presence of over 20 other persons allied to her,” Kanchori stated in the affidavit.
