Haji said he is convinced that there is evidence to support the charges committed under the International Crimes Act.

Director of Public Prosecution Noordin Hajio has recommended the prosecution of police officers arrested over the death of Baby Pendo.

According to Haji, the officers will be charged with murder, torture and rape.

The officers will also be liable for the 2017 Kisumu post-poll chaos.

In a statement on Friday, Haji said he is convinced that there is evidence to support the charges committed under the International Crimes Act.

“With a realistic prospect of the conviction and that it is in the public interest to charge the suspected officers with Murder, rape and torture as a crime against Humanity,” he said.

Haji however did not close the identity of the suspects. This is to allow their protection and that of the victims.

The DPP stated that the Case was complex, hence the delay in handling the matter.

Haji stated that the probe found out that the officer may have played a role in the macabre killing of baby Pendo.

“ The violations include raiding homes of innocent unarmed civilians and committing various atrocities as part of a systematic and widespread attack against the civilian population in the said areas,” he said.
