Kakamega Senator Boni Khalwale has sued UDA Secretary General Cleophas Malalah at the UDA Disputes and Resolutions Committee over the appointment of regional and county managers for the party grassroots elections scheduled in December.
In a petition seen by Nairobileo.co.ke on Monday, October 9, Khalwale claimed that the appointments were done without any evidence of consultations with other relevant party organs.
He also said the Malalah had overstepped its mandate and that the appointments were unprocedural and tainted by open favouritism to his friends.
The Kakamega Senator requested the committee to issue an injunction restraining Malalah from undertaking his role as the UDA Secretary General until the matter is heard and determined.
“That, pending the hearing and determination of the petition, the Honorable Committee be pleased to issue an injunction to restrain the Respondent, Cleophas Malala Wakhungu, from exercising the functions of the office of the Secretary General of the Interested Party, the United Democratic Alliance,” the petition read in part.

Khalwale argued that if the disciplinary committee did not issue the conservatory order, Malalah would continue to use his position to take advantage of situations that would benefit him to the detriment of the petitioners and other party members.
“The Respondent has usurped the powers and functions of the National Elections Board, the only organ within the party that is mandated to deal with the matters of internal party elections.
“The Petitioners will suffer irreparable personal loss and prejudice if the Honorable Committee does not intervene,” the petition added.
