The Independent Electoral Boundaries Commission (IEBC) has asked the Director of Public Prosecutions (DPP) Noordin Haji to take action on DP William Ruto and ODM leader Raila Odinga.

The Independent Electoral Boundaries Commission (IEBC) has written to the Director of Public Prosecutions (DPP) Noordin Haji over the use of public resources ahead of the August 9 general election.

In a letter dated March 22, IEBC stated that the Third Way Alliance Party had written to the commission expressing displeasure with the use of public resources for personal and political gain.

The party singled out Deputy President William Ruto and ODM leader Raila Odinga in their letter to IEBC on March 11.

“The Party has singled out the Deputy President Dr. William Ruto and former Prime Minister Raila Odinga as having an undue advantage over other aspirants by dint of using public resources thus enjoying a competitive edge,” read part of the IEBC letter signed by Chairman Wafula Chebukati.

The electoral body stated that Section 14 of the Election Offences Act, 2016 disallows the use of public resources for campaigning during an election.

“Pursuant to Section 21 of the Act, it is the Director of Public Prosecution that has power to order investigations and to prosecute offences under the Act,” Chebukati stated.

“It is in this premise that we wish to escalate this complaint to your office to deal since the same falls under your purview,” he added.

Ruto and Raila have undoubtedly been the highest spenders ahead of the upcoming polls with analysts noting that this year’s campaigns will be the most expensive in Kenyan history.
