Thirdway Alliance Party Interim leader Miruru Waweru has moved to table more evidence in the Constitution Amendment Bill 2020 otherwise known as the Building Bridges Initiative (BBI) appeal prior to the hearing of the main appeal.
Through lawyer, Elias Mutuma, Waweru is seeking to file a joint report of the departmental committee on Justice and Legal Affairs Committee and Senate Standing committee on Justice, Legal Affairs and human rights.
"The report provides a detailed analysis by Parliament of the BBI bill for its constitutional and legal validity, and with the consideration of input from members of the public," Mutuma stated in his application.
Waweru was among the petitioners in the High Court case that declared the BBI unconstitutional and unlawful.
The decision was appealed by ODM Leader Raila Odinga, President Uhuru Kenyatta, the BBI steering committee, the Independent Electoral and Boundaries Commission (IEBC), and the Attorney General.
According to Waweru, committees from the National Assembly and Senate a=had adopted the joint report which sought to regulate the amendment of the Constitution by popular intiative.
He argued that the report could not be submitted as evidence in the High Court because it was non-existent at the time.
"The report was released after the close of the hearing of the petitions. The appellants will not be prejudiced by the inclusion of this evidence," he said.
Waweru is seeking to have the application heard before the hearing of the main appeal slotted for June 29 to July 2.
