Former President Uhuru Kenyatta has been sued by Former nominated MP Hassan Osman over his involvement in the Jubilee Party affairs.
Osman is also seeking to block the Jubilee party National Delegates Convention planned for May 22.
In court papers seen by Nairobi Leo, the former president is accused of plotting to overhaul the constitution.
Osman has told the court that he is a bonafide member of the ruling Jubilee party.

"I wish to state that the respondents have tried to purport to remove or change the party constitution, membership and leadership when the same is unlawful, illegal and unprocedural,'" Osman says.
He argued that the change is to allow for the participation of unauthorized personnel in the Jubilee NDC.
Osman wants the Political Parties Disputes Resolution Tribunal to declare the planned NDC illegal.
He said there was no NEC meeting held that approved the calling of an NDC.
"I wish to state that the branch offices of the Jubilee party are not currently functional raising concerns about the safety of party documents,'" he added.
Osman has listed Uhuru and Kioni as respondents in his petition.
He said the former ruling party stands to suffer irreparable loss and damages unless respondents are restrained from continuing with "the ongoing illegal actions of acting, conducting and dealing on behalf of the Jubilee party".
In a notice dated April 4, Uhuru summoned Jubilee delegates for a special NDC on May 22.
