Kingi delivered his ruling following the objection raised by Gachagua's team.

Senate Speaker Amason Kingi has dismissed the objection by Deputy President Rigathi Gachagua on the representation of the National Assembly by Siaya Governor James Orengo. 

In his ruling, the Speaker opined that Gachagua's team did not prove that Orengo was earning an income or benefitting personally from his involvement in the hearings. 

"The Speaker of the Senate Amason Kingi rules that the preliminary objection raised by the Deputy President's counsels on the appearance of Senior Counsel James Orengo for the National Assembly is dismissed," the Senate announced.

Orengo was chosen as the lead counsel for the National Assembly during the hearings.

However, Gachagua's team objected to the representation arguing that the Senior Counsel was a state officer.

They cited an instance when the Senate prevented South Mugirango MP Silvanus Osoro from representing former Kisii Deputy Governor Robert Monda during his impeachment in the Senate.

However, in his ruling, Kingi explained that Osoro was barred from the hearing because he was a senior official in Parliament and was from Kisii County hence conflict of interest.

Other lawyers representing the National Assembly include Mouthomi Thiankolu, Peter Wanyama, Melly Kennedy Kipkoech, Paul Nyamondi, Eric Gumbo, Kipkogei Moses Kipkemoi, and Joan Jeruto.

On his part, Gachagua is being represented by Senior Counsel Paul Muite and assisted by Elisha Ongoya, Swanya Victor Ogeto, Ndegwa Njiru, Tom Macharia, and John Njomo among others.
