  • Senator Kipchumba Murkomen disclosed that the cases was one of the reasons why he was dropped as the Senate Majority Leader

Elgeyo Marakwet Senator Kipchumba Murkomen has celebrated the High Court decision to quash at least 23 Laws that were passed by the National Assembly without the involvement of Senate.

According to the former majority leader, the controversial case was the main reason he fell out with President Uhuru Kenyatta leading to his demotion at the Senate.

Murkomen, listed in the matter as petitioner No.3, says the house leadership went to court after he unsuccessfully sought the intervention of the President Uhuru Kenyatta on the matter.

"I celebrate this decision even though it is one of the issues that put me in trouble with the Executive. What is important is that the Senate and Devolution is protected.

Speaker of Senate Ken Lusaka and Minority Leader Senator James Orengo were petitioners in the case.


The Senate had pro-bono legal representation led by Senior Counsels James Orengo and the Nyamira Senator Okong'o Omogeni.

Former Senate Deputy Speaker Senator Kithure Kindiki termed the High Court ruling as a major breakthrough for devolution.

The High Court ruling further indicated that all Bills pending before the National Assembly concerning which the participation, concurrence and input of the Senate has not obtained are suspended forthwith.
