Professor Makau Mutua said he would be of no use to the government if he cannot advise President Ruto truthfully.

President Ruto's senior advisor, Professor Makau Mutua, now says he will resign from the government if certain events occur that he is not satisfied with.

Speaking on Wednesday, September 10, Professor Makau Mutua said he is not in government to whitewash anything.

The renowned scholar emphasized that he would be of no use to the government or to President Ruto if he cannot tell him the truth.

“I am not in this government to whitewash or cover up anything. If things happen that I am not happy with or my conscience cannot live with, I will resign.

“Because I will not be of any use to the government and to the President if I cannot tell him the truth,” said Mutua.

Mutua also issued a public apology over the deaths and injuries witnessed during the Gen Z protests.

He described the events witnessed during the June 2024 and June 2025 protests as regrettable.

“This is regrettable, and I think all of us, some of us are fathers, others are brothers, when we see these activities taking place, we hurt for our fellow citizens.

“And all of us are humans, and so I just want to say, on behalf of everyone in this country, that we are all sorry about what happened,” he stated.

President William Ruto, on April 30, appointed Mutua to be a Senior Advisor on Constitutional Affairs in the Executive Office of the President.

In a statement, Ruto praised Mutua’s extensive background in legal and constitutional matters and welcomed him to his team.

"I have appointed Prof Makau Mutua as the Senior Advisor of Constitutional Affairs in the Executive Office of the President. Prof Mutua brings a wealth of experience in legal, constitutional, and human rights matters.

"Congratulations, Prof Mutua. I welcome you to join a dynamic team of public servants in the implementation of our Bottom-Up Economic Transformation Agenda," he wrote on social media platform X.

The Head of State, on August 8, established a special framework to provide compensation to victims of demonstrations and protests since 2017 and appointed Mutua as the Principal Coordinator.

President Ruto also appointed a committee comprising 19 members, chaired by Mutua, with LSK President Faith Odhiambo deputizing him.

However, the high court issued a conservatory order that temporarily halted the committee’s operations following a petition filed by lawyer Levi Munyeri.
